All services provided by izaBE design studio are subject to the following terms and conditions. These policies have been put into place to protect both the client and izaBE design studio. If you do not agree with any element of the Terms and Conditions, please do not contact me for a quote or for services. By purchasing any service, you are agreeing to the terms and conditions as expressed below.
Quotes & Contracts
Quotes provided will be honored for 30 days. A new quote will then be provided upon request. Contracts that have been written, but not signed by the client will only be accepted within 30 days of the delivery date. A new contract may be drawn up upon request.
Web Design
Waiting List
An initial, non-refundable 25% deposit is required to hold the client's place should a waiting list be in effect. If the client chooses to pay for the first half of the design to be added to the waiting list, please know that it is also non-refundable. All waiting list designs are started by the 15th of the month unless another date has been communicated with the client.
*Note - I try and email all of my waiting list clients periodically but sometimes only get a chance to correspond a few days before the design is to begin. I am happy to answer email if a client wants a status update or has any questions.
Authorization
The client is engaging izaBE design studio, a sole proprietor, as an independent contractor. The client hereby authorizes izaBE design studio to access any hosting or domain account for the sole purpose of installing and updating the web product. The client also authorizes the hosting service to provide izaBE design studio with complete access to the client's account and any other programs needed for this web design project as deemed necessary by the client/designer agreement. Hourly Rate/Revisions
The client is allowed two (2) major rounds of revisions for their web design. Major revisions include a completely new layout, new graphics, new features or functionality. Minor revisions are accepted throughout the design process within reason. If you the client should go over this amount, a fee will be required. Hourly rates start at $45.00.
Development
The design project will be developed using various commercial software products. While izaBE design studio will make every effort to design a fully functional website the warranty does not cover AOL, text-based browsers or any other special effects that izaBE design studio may advise against. Any claims for defects, corrections, or glitches must be made within 14 days of the project being completed. All requests made after the 14 day period may be subject to additional fees at the normal hourly rate.
Completion
izaBE design studio works hard to complete all projects in a timely manner and will provide the client with an estimated time of delivery for the project (usually 60 days from start to finish). However, izaBE design studio cannot guarantee deadlines as each project is unique and so is each client. izaBE design studio will communicate with the client during the entire development of the project and provide them with status updates. If the client does not supply izaBE design studio with complete text and graphic content for this web design project within 15 days of the date of the purchase agreement, the contract becomes void and any deposits are forfeited. Payment of Fees and Expenses
A payment of 50% of the remaining balance shall be remitted upon signing the contract. No web design will begin until both the payment is made and the signed contract is received. The client understands that before installation, the remaining 50% will be due. Upon receipt of final payment, the website design will be published to the client's hosting service. All payments will be made in U.S. funds. If paying by check, you agree that should your bank return your check for any reason, you will be liable for any additional fees incurred by izaBE design studio. You further agree that should your bank return your check(s), for any reason, izaBE design studio will charge you a $30.00 fee and you will be responsible for payment in full upon notification by your bank, and/or izaBE design studio. If final payment is not received within 30 days of the completion of service, additional fees will be added. Hosting
The client understands that hosting services are not included with the web design project. The client will be solely responsible for any and all hosting service charges.
Credit and Use of Products
The izaBE design studio copyright and credit information must remain on all of our products. We require that the text link back to izabegraphicdesign.com remain in place and in working order. All preliminary proofs ncluding graphics, layouts, etc, which are not selected by the client remain the full property of izaBE design studio and may be used in future projects for other clients Copyrights and Trademarks
Copying images, text or design layouts from other sites is not condoned by izaBE design studio. Any text, images and products provided must be owned by the client and must have expressed written permission to use. Under NO circumstances will izaBE design studio be held liable for content provided by a client on a client website. The client will be responsible for paying any and all legal expenses that are a result of lawsuit against izaBE design studio for graphics, images and/or content which is provided by and used by the client. Copyright to Web Pages
Copyright to the finished assembled work of web pages produced by izaBE design studio is owned by izaBE design studio. Upon final payment of the contract, the client is assigned rights to use as a web site the design, graphics, and text contained in the finished assembled web site. The copyright must remain in tact and visible on the site. Under no circumstances shall a site be duplicated, sold or redistributed. The client must use the products as they were intended by izaBE design studio. When final payment is made, ownership transfers to the client but the copyright must remain in tact. The client may not alter or reuse the HTML, XHTML and/or CSS coding that is provided to without the direct written consent of izaBE design studio.
Consultation
The client will receive a phone consultation once the site has been completed and turned over to them. Unless specified, a representative (Lisa Bacon) of izaBE design studio will call the client so that they do not incur any long distance charges. The representative will go through basic functions to help familiarize the client with their site. The client must have access to a computer as site features will be reviewed in real time. This consultation may take up to 90 minutes, depending on which services are provided. The time and date of the consultation will be agreed upon in advance by the client and izaBE design studio.
Support
E-mail support is available for 30 days after the site has been completed and turned over to the client. After 30 days, there may be a hourly charge for support. This will depend on each individual situation
Other Design Services
Payments
Payment is required up front at the time of order for all design services (except web design). izaBE design studio does not provide refunds unless agreed upon by both the client and izaBE design studio.
Completion Date
izaBE design studio and the client must work together to complete the design project in a timely manner. The first set of clients proofs are delivered within 10-12 business days after the return of the Custom Logo Design Questionnaire. However, izaBE design studio cannot guarantee deadlines as each
project is unique and so is each client. izaBE design studio will
communicate with the client during the entire development of the
project and provide them with status updates. Project Delivery
Upon completion of the project, all files will be sent to the client. izaBE design studio does not require any credit back for logo design. (updated 04/22/08) You will own the rights to your logo design once it is complete.
Alterations and Use
No alterations or revisions of any kind are allowed on any of products designed by izaBE design studio without direct written consent. All preliminary proofs that include graphics, layouts, etc, which are not selected by the client remain the full property of izaBE design studio and may be used in future projects for other clients.
Refunds
izaBE design studio does not provide refunds unless agreed upon by both the client and izaBE design studio. This also includes any deposits paid for the waiting list for web design. The client must submit termination of services to in writing. In the event of a cancellation of contract, ownership of all artwork, layouts and development remain the property of izaBE design studio and will NOT be transferred to the client. Chargebacks
izaBE design studio will not negotiate chargebacks with any person or company. Charge backs are NEVER acceptable means of attaining a refund. To request a chargeback on your credit card for a valid transaction is considered fraud. Fraudulent credit card chargebacks will be aggressively prosecuted and reported to all major credit bureaus as a delinquent collection account. Should a chargeback be filed against izaBE design studio, we will not hesitate to proceed with collection and legal action to recover funds. Non-Communication
If izaBE design studio is unable to communicate with a client on a project for a duration of at least thirty days (30) by phone or email during the design and development process, the project will be canceled without prior notice and ny monies paid will be forfeited to izaBE design studio. Acceptance
Please note that by submitting your payment for my services you are agreeing to all of the terms of service as written here. izaBE design studio reserves the right to change or update these terms at any time without prior notice.
Privacy Policy
izaBE design studio does not share any information you provide to us
to any parties (public or private). If you do not want to be added to
our mailing list, you must specify when completing your transaction.
Otherwise, izaBE design studio reserves the right to send you
correspondence (newsletters) by email.
You will receive an emailed receipt for your transaction, even if you opted not to receive our newsletter. If you have any questions about this policy, please email us. We are happy to help!
